Privacy Policy
- The Confidential Information of industrial and/or commercial application derived from this Privacy Policy, our Terms and all our Legal framework, in any physical or electronic form, including but not limited to: Concepts, scripts, sketches, drafts, drawings, trials or preliminary proofs or work, plans, characters, setting, backgrounds, scenography , storyboards, descriptions, special effects, sound effects, music, voice recordings, translations, dubbing, props, models, animation techniques and styles, processes, databases, digital libraries, animations, audiovisuals, trailers, brands, trade secrets, all kinds of inventions, as well as any physical or digital material that may be capable of being protected as by copyright.
- We (you, your user(s) and us; also referred as The Parties) undertake to maintain confidentiality and secrecy regarding Confidential Information during the term of our entire Legal framework and during the 10 (ten) years after its termination.
- The Parties undertake not to reveal, disclose, transmit, store, duplicate or in any other way copy or make known to any person the Confidential Information, and not to use it for any other purpose other than and/ or unrelated to the Services.
- The Parties agree that in the event of termination of any item in our Legal framework, whatever the reason, the Confidential Information of which each Party is the owner or holder, as well as the material supports containing it, will be reciprocally returned, at the latest within 10 (ten) business days from the effective date of termination.
- In the event that any Part fail to comply with any of its obligations under any item in our Legal framework, it will be responsible for the damages caused to the parties due to said non-compliance, without prejudice to the criminal liability that it may incur for its non-compliance with the terms of articles 82, 86, and 223 sections IV, V and VI of the Industrial Property Law, 143 of the Penal Code for the State of Jalisco and its correlatives in the Mexican Republic and 67, 68 and 69 of the Federal Law of Protection of Personal Data in Possession of Individuals.
- The Parties agree:
- Not to use any Confidential Information or Confidential Trade Information for its own use or for any purpose other than the specific purpose of completing the Services.
- Not to voluntarily disclose any Confidential Information or Confidential Trade Information to any other person or entity.
- To take all reasonable measures to protect the secrecy of, and avoid disclosure or use of, Confidential Information and/or Confidential Trade Information in order to prevent it from falling into the public domain or the possession of persons other than those persons authorized hereunder to have such Confidential Information and/or Confidential Trade Information. The foregoing duty shall survive any termination or expiration of this Agreement.
- In no event You and/or Your User(s) shall use Confidential Information to reverse engineer or otherwise develop products or services functionally equivalent to Our products and/or services.
- The parties agree that the disclosure of any of the Enable Systems Confidential Information shall give rise to irreparable injury to Us (Enable Systems), inadequately compensable in monetary damages. Accordingly, the nondisclosing party may seek and obtain injunctive relief against the breach or threatened breach of the foregoing undertakings, in addition to any other legal remedies which may be available.
Data Protection
- Personal data may be processed without the consent of the owner, always with respect to fundamental rights, users' rights; having as exceptions to the principles governing the processing of data, national security, public order provisions, public safety and health or to protect the rights of third parties, as established in the second paragraph of Article 16 of the Political Constitution of the United Mexican States; as well as in the cases provided for in sections II to VI of Article 22 of the Federal Law on Transparency and Access to Public Information in relation to the second transitory article of the Decree by which the Federal Law on Transparency and Access to Public Information is repealed and the Federal Law on Transparency and Access to Public Information is issued and the Twenty-Second Guideline of the Guidelines for the Protection of Personal Data; as well as Article 117 of the Federal Law on Transparency and Access to Public Information.
- Therefore, by accepting our "Privacy Policy", you authorize the transmission of your personal data, as well as the information and electronic documents generated through any of our Products and/or Services, Suppliers, Affiliates, Subsidiaries and/or any other entity that is linked to Enable Systems.
- The personal data collected will only be shared among our Products and/or Services, Suppliers, Affiliates, Subsidiaries and/or any other entity that is linked to Enable Systems when the service to be performed so warrants and the data is used for the exercise of their own powers, the above based on the applicable provisions in force.
- Personal data may be provided to third parties when contracting the provision of a service that requires the processing of personal data. Such third parties may not use the personal data for purposes other than those for which they were transmitted. The misuse of the information by a public servant may be sanctioned in accordance with the applicable legal provisions.
- Besides our Legal framework (Terms of Service, Privacy Policy, etc.) You and Your User(s) registered in any of our APPs could be protected by the General Law for the Protection of Personal Data in Possession of Regulated Entities Obligated (Ley General de Protección de Datos Personales en Posesión de Sujetos Obligados) from the United Mexican States.
